These Terms and Conditions for Application (“Application Terms”) govern the submission of your application to NXT Footballer SL (“we”, “us”, “our”) for participation in our football programs and services. By submitting an application, you agree to comply with and be bound by these Application Terms, our Website Terms and Conditions, Privacy Policy, and Cookie Policy.

1. Applicant Eligibility and Age Restrictions

Minimum Age: The application form is intended solely for individuals who are 14 years of age or older. By submitting an application, you confirm that you are at least 14 years old.
Minors Under 14: If the applicant is under the age of 14, a parent or legal guardian must contact us directly via email at contact@nxtfootballer.com to initiate the application process on their behalf.
Contractual Age: While individuals 14 and older may apply, formal service contracts for our programs require the participant or a responsible parent/guardian to be 18 years of age or older. This application does not constitute a service contract or a guarantee of acceptance.

2. Accuracy of Information

You agree that all information provided in your application form is accurate, complete, truthful, and up to date. You are responsible for ensuring the data provided about any third parties (e.g., family members, previous coaches) is accurate and that you have their permission to share it with us.

We reserve the right to reject any application or revoke acceptance at any time if the information provided is found to be false, incomplete, or misleading.

3. Application Process and Assessment

No Guarantee of Acceptance: Submitting an application does not guarantee acceptance into any NXT Footballer program, a contract with a club, or the provision of services. All applications are subject to a formal assessment and evaluation process.
Assessment Data: You consent to us using the performance metrics, historical data, and educational information you provide to conduct our internal assessments.

4. Data Protection and Privacy

Your personal data provided in this application will be processed in accordance with our Privacy Notice for Application Form.

By submitting this form, you acknowledge that you have read and understood how we collect, use, and retain your data.
Marketing Consent: If you choose to opt-in to marketing communications (via email, WhatsApp, or other methods), you provide explicit consent to receive promotional messages and opportunities. You may withdraw this consent at any time via the unsubscribe links or instructions provided in those messages (e.g., replying “STOP” on WhatsApp).

5. Intellectual Property (Images and Videos)

If you upload images or videos as part of your application, you confirm that you own the rights to this content or have the necessary permissions from the copyright holder(s) and the individuals featured. You grant NXT Footballer SL a limited, non-exclusive license to use this content solely for the purpose of your application assessment.

We will seek explicit, separate consent before using any images or videos for marketing or promotional purposes.

6. Limitation of Liability

To the fullest extent permitted by Spanish law, NXT Footballer SL shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the application process or reliance on the information provided herein. Our liability is limited to the extent outlined in our general Website Terms and Conditions.

7. Governing Law and Jurisdiction

These Application Terms are governed by the laws of Spain. Any disputes arising from or related to this application process shall be subject to the exclusive jurisdiction of the Spanish courts in Malaga.

8. Changes to These Terms

We may update these Application Terms periodically. The revised terms will be posted on this page with an updated Effective Date. Your continued participation in the application process (e.g., submitting further requested documents) after changes are posted constitutes acceptance of the new terms.
